By accessing and using UtiliCard's services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services.
UtiliCard provides payment processing, billing software, customer notification systems, and related services specifically designed for utility companies. Our services include but are not limited to:
To access our services, you must provide accurate and complete information during the registration process. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
Payment processing fees are charged according to the rate schedule provided in your merchant agreement. Fees are typically deducted from your settlement funds. Additional services may be subject to separate fees as outlined in your service agreement.
We maintain industry-standard security measures to protect your data and comply with PCI DSS requirements. However, no system is completely secure, and you acknowledge that you provide information at your own risk. We are not responsible for unauthorized access to your data that results from your failure to maintain adequate security measures.
You agree not to use our services for any unlawful or prohibited activities, including but not limited to:
We strive to maintain 99.9% uptime for our services. Scheduled maintenance will be announced in advance when possible. In the event of service interruptions, we will work diligently to restore service as quickly as possible.
All content, software, and materials provided by UtiliCard are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our proprietary materials without explicit written permission.
UtiliCard's liability is limited to the fees paid for our services during the month in which the claim arose. We are not liable for indirect, incidental, or consequential damages, including but not limited to lost profits, data loss, or business interruption.
Either party may terminate the service agreement with appropriate notice as specified in your merchant agreement. Upon termination, you remain responsible for all outstanding fees and must return any equipment provided by UtiliCard.
Any disputes arising from these terms or our services will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will take place in Texas, and Texas law will govern these terms.
We reserve the right to modify these terms at any time. Changes will be posted on our website and take effect 30 days after posting. Continued use of our services after changes indicates acceptance of the new terms.
